FOX LIMO NATIONWIDE — TERMS AND CONDITIONS OF USE OF SERVICES

These Terms and Conditions ("Terms") govern your access to and use of the website, mobile application, and chauffeured transportation services (collectively, the "Services") offered by Fox Limo Nationwide ("Fox Limo Nationwide," "Company," "we," "us," or "our"). By accessing our website, using our mobile application, or booking a reservation, you ("Customer," "Passenger," or "you") agree to be bound by these Terms. If you do not agree to these Terms, do not use the Services.
1. Description of Services
Fox Limo Nationwide provides limousine and chauffeured ground transportation services to customers throughout the United States, bookable through our website, our mobile application, and by phone or other channels we may make available. Service availability, vehicle types, and coverage areas vary by location and are subject to change without notice.
2. Eligibility
You must be at least 18 years old and capable of forming a legally binding contract to create an account, make a booking, or otherwise use the Services. By using the Services, you represent that you meet these requirements. Reservations made on behalf of a minor must be made and supervised by a parent, legal guardian, or other responsible adult.
3. Account Registration
Certain features of the website and mobile application may require you to create an account. You agree to:
Provide accurate, current, and complete information during registration;
Maintain and promptly update your account information;
Keep your login credentials confidential and not share them with others;
Notify us immediately of any unauthorized use of your account.
You are responsible for all activity that occurs under your account.
4. Bookings, Reservations, and Payment
4.1 Making a Reservation
Reservations may be made through our website, our mobile application, or by contacting us directly. You are responsible for providing accurate pickup location, destination, date, time, passenger count, and contact information at the time of booking.
4.2 Pricing and Fees
Rates are based on factors including vehicle type, distance, duration, time of day, wait time, gratuity, tolls, fuel surcharges, and applicable taxes. Quoted prices are estimates unless expressly confirmed as final at the time of booking; additional charges may apply for extra stops, extended wait time, additional passengers or luggage, cleaning fees, or other special circumstances.
4.3 Payment
Payment is due as described at the time of booking. We accept the payment methods displayed on our website or application. By providing payment information, you represent that you are authorized to use the payment method and authorize us (or our third-party payment processor) to charge the applicable amounts, including any additional charges incurred under Section 4.2.
4.4 Cancellations and No-Shows
Cancellation deadlines, applicable fees, and refund eligibility will be provided at the time of booking and may vary by service type, vehicle, and market. Failure to be present at the designated pickup location within the applicable grace period may be treated as a no-show and billed accordingly.
5. Passenger Conduct
You agree to:
Treat chauffeurs, staff, and vehicles with respect;
Comply with all applicable laws, including those regarding open containers of alcohol, controlled substances, and smoking;
Refrain from violent, abusive, threatening, or illegal conduct;
Not exceed the vehicle's rated passenger capacity;
Be responsible for the conduct of all passengers in your party.
We reserve the right to refuse or terminate service, without refund, to any passenger who violates this Section or whose conduct poses a safety risk to the chauffeur, other passengers, or the public. You are responsible for any damage to a vehicle caused by you or a member of your party, including cleaning fees for excessive mess or damage caused by illness, spills, or smoking.
6. Vehicles and Chauffeurs
We strive to provide the vehicle type reserved; however, we reserve the right to substitute a comparable or upgraded vehicle due to availability, mechanical issues, or circumstances beyond our control. Chauffeurs may, at their discretion, alter routes based on traffic, weather, road conditions, or safety considerations.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOX LIMO NATIONWIDE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, INCLUDING DELAYS, MISSED CONNECTIONS, OR SCHEDULING CHANGES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE RESERVATION GIVING RISE TO THE CLAIM. Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.
8. Insurance
Fox Limo Nationwide maintains commercial automobile liability insurance in accordance with applicable federal and state requirements for the jurisdictions in which it operates. Details of coverage are available upon request and do not constitute a guarantee against all forms of loss.
9. Indemnification
You agree to indemnify, defend, and hold harmless Fox Limo Nationwide, its officers, directors, employees, contractors, and chauffeurs from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your violation of these Terms, your misuse of the Services, or your violation of any rights of a third party.
10. Force Majeure
Fox Limo Nationwide shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, severe weather, natural disasters, traffic accidents, road closures, government action, labor disputes, or mechanical failure.
11. Intellectual Property
All content on our website and mobile application, including logos, trademarks, text, graphics, and software, is the property of Fox Limo Nationwide or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our prior written consent.
12. Mobile Application
Use of our mobile application is subject to these Terms as well as any additional terms presented within the application, including permissions related to location services, notifications, and camera or photo access, which you may enable or disable through your device settings.
13. Prohibited Uses
You agree not to:
Use the Services for any unlawful purpose;
Attempt to gain unauthorized access to our systems or another user's account;
Interfere with or disrupt the operation of the website or mobile application;
Submit fraudulent booking or payment information;
Use automated means (bots, scrapers) to access the Services without our written permission.
14. Termination
We reserve the right to suspend or terminate your account or access to the Services at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful to other users, third parties, or our business interests.
15. Dispute Resolution
Any dispute arising out of or relating to these Terms or the Services shall first be addressed through good-faith negotiation between the parties. If a dispute cannot be resolved informally, it shall be resolved through binding arbitration or in a court of competent jurisdiction located in the State of New Jersey, as further described in Section 16.
16. Governing Law and Venue
These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of laws principles. You agree that any legal action or proceeding arising out of these Terms shall be brought exclusively in the state or federal courts located in New Jersey, and you consent to the personal jurisdiction of such courts.
17. Changes to These Terms
We may revise these Terms from time to time. The updated version will be indicated by a revised "Effective Date," and the updated version will be effective as soon as it is accessible. Your continued use of the Services after any revisions become effective constitutes your acceptance of the revised Terms.
18. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.
19. Entire Agreement
These Terms, together with our Privacy Policy and any additional terms referenced herein, constitute the entire agreement between you and Fox Limo Nationwide regarding the Services and supersede any prior agreements.
